1. Acceptance of Terms

By accessing or using study.masteringbds.com (the “Service”, “Platform”), you accept and agree to be bound by these Terms & Conditions (“T&C”), our Privacy Policy, and all applicable laws and regulations. If you do not agree, do not use the Platform.

2. Services Provided

Study by MasteringBDS offers digital educational products: test series, question-banks, downloadable PDF notes, simulated exams, subscription access, and related digital services (collectively “Content”). Features, availability, plan details, and pricing are displayed on the Platform and may change from time to time.

3. Account, Eligibility & Use

• Users must be 18+ or have parental/guardian consent to purchase/use services.

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

4. Intellectual Property & Limited License

• All Content, designs, materials, question banks, tests, PDFs, logos, trademarks, and software on the Platform are owned or licensed by MasteringBDS and are protected by copyright and other laws.

• You are granted a non-exclusive, non-transferable, revocable license to use Content for personal, non-commercial educational purposes only. Any reproduction, distribution, public performance, resale, adaptation, or unauthorized sharing (including uploading to third-party file-sharing sites or social media) is strictly prohibited.

• We expressly reserve all rights not expressly granted.

5. Payment, Pricing & Taxes

• All fees are as displayed at the time of purchase. Prices may include applicable taxes. If not shown, users are responsible for applicable taxes (GST etc.) as per law.

• Payment methods supported will be displayed on the checkout page; payments processed via our payment gateway are subject to the gateway’s terms.

6. No Refund Policy (Primary)

Our policy: All purchases (one-time purchases, subscriptions, course fees, downloads, and add-ons) are non-refundable except where otherwise stated below.

Why: Digital educational content is delivered immediately or made available for download and once accessed can be copied, stored and used. To ensure clarity and fairness we operate a strict no-refund policy.

Exceptions / Statutory Rights (required & limited): Notwithstanding the foregoing, refunds will be processed where required by applicable law or regulatory rules (for example, in cases of:** (a) unauthorized or fraudulent transactions; (b) multiple charges in error; (c) failure to deliver the purchased service by the provider**). Additionally, any consumer claim arising under the Consumer Protection Act or the Consumer Protection (E-Commerce) Rules will be handled per law. In short, the “no-refund” policy does not override mandatory statutory consumer rights.

How we handle disputes: If you claim a refund under an exception, contact support at exam@masteringbds.com or nursingmastering@gmail.com with full details. We will investigate and respond within a reasonable time.

7. Subscriptions, Auto-Renewal & Cancellations

• Subscription plans (if any) will be billed as specified (one-time, monthly, yearly). Some subscriptions auto-renew unless cancelled prior to renewal date.

• To cancel auto-renewal, use your account settings or contact support at least 48 hours before the renewal date. Cancellation prevents future billing but does not entitle the user to refunds for prior charges (subject to Exception clause above).

• We reserve the right to modify subscription features and pricing; existing subscribers will be notified of material changes.

8. Access, Service Availability & Changes

• We strive for uninterrupted service but do not guarantee continuous, error-free access. The Platform may be temporarily unavailable for maintenance or upgrades.

• We may change, suspend, or discontinue any part of the Platform or Content without prior notice. When practical, we’ll try to notify users for material changes.

9. Acceptable Use & Prohibited Conduct

You agree not to:

• Copy, scrape, reverse-engineer or reuse Content beyond the limited license provided.

• Use the Service for illegal activities or to transmit unlawful content.

• Share account credentials or allow unauthorized access.
  Violation may lead to immediate termination of access and legal action.

10. Refund & Chargeback Handling with Payment Processors

• If you raise a chargeback with your bank or payment provider, MasteringBDS may suspend the related account until the dispute resolves. If the dispute is found in our favor, we may reinstate access and recover chargeback funds. Repeated chargebacks may lead to account termination.

11. Privacy & Data Protection

We process personal data as described in our Privacy Policy. We follow applicable Indian data protection laws, including obligations under the Digital Personal Data Protection Act, 2023 and the Information Technology Act where applicable. Please see our Privacy Policy for details on collection, processing, retention, and your rights. 

12. Grievance & Takedown Policy

• For complaints about Content or IP infringements, contact: exam@masteringbds.com or nursingmastering@gmail.com. Provide full details and supporting evidence. We will investigate and take action where warranted.

• For e-commerce consumer grievance: you may contact our grievance officer at the above emails or WhatsApp helpline. We commit to acknowledging consumer grievances promptly and seeking resolution.

13. Disclaimers & Limitation of Liability

• No warranties: Content is provided “as is”. We do not guarantee exam pass results, accuracy, or completeness of Content. Educational outcomes vary by user effort.

• Limitation: To the fullest extent permitted by law, Study by MasteringBDS and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of use of the Platform. Our aggregate liability in any case will not exceed amounts actually paid by you to MasteringBDS in the preceding 12 months (if any). This limitation will not apply to willful misconduct or where law prohibits such limitation.

14. Termination & Suspension

We may suspend or terminate accounts for violations of these T&C, fraud, misuse, or unlawful behavior. On termination, access to paid Content may be revoked. Termination does not relieve you of outstanding payment obligations.

15. Notices & Communication

We may provide notices by email, SMS or platform notifications. You agree that electronic communications satisfy any legal requirement for written notice.

16. Modification of Terms

We may change these T&C at any time. Material changes will be notified on the Platform or by email. Continued use after notice constitutes acceptance.

17. Governing Law, Jurisdiction & Dispute Resolution

• Jurisdiction: Courts at Churu / Rajasthan shall have exclusive jurisdiction for disputes, subject to mandatory consumer statutory rules. If a dispute is a consumer dispute, applicable consumer fora / remedies under Consumer Protection law will apply. Note: arbitration clauses may not bind consumers unless voluntary and agreed after dispute arises—per judicial guidance—so we do not mandate pre-dispute mandatory arbitration here.

18. Miscellaneous

• Severability: If any provision is held invalid, remainder remains in force.

• Entire Agreement: These T&C and Privacy Policy constitute the entire agreement between you and MasteringBDS regarding the Platform.
